Terms of Service

I. Acceptance
By utilizing any services, hardware, or software provided by ConnectedHotel, you agree to the following Terms of Service in full and without limitation.

II. Definitions
a. Guest: The term guest shall mean any person or software that:
i. Connects to or utilizes hardware provided by ConnectedHotel
ii. Uses any services provided by ConnectedHotel. Some services may require additional Terms of Service
iii. Contacts or attempts to contact ConnectedHotel technical support
b. Provider: The term provider shall mean Nanucom L.L.C. (dba ConnectedHotel)

III. Agreement
All Services are provided by Provider on an 'as is' basis. No warranties, representation or endorsements, express or implied including, but not limited to, quality and availability of service, are made with respect to this service. You release ConnectedHotel from, and ConnectedHotel shall have no liability or responsibility for any direct, indirect, incidental or consequential damages suffered by Guest in connection with your use of or inability to use the service, including but not limited to, damages loss of data from internet delays, non-deliver, mis-deliver, or interruptions, or due to inadvertent release or disclosure of information sent by you, even if the same is caused by negligence on the part of ConnectedHotel. Under no circumstances shall Provider be liable for any conduct, content, goods, data and services available on or through the internet. Use of any information or data obtained via this service and/or the internet is at the sole discretion and risk of the Guest.

Acceptance of the Terms of Service also means that Guest will not, nor will allow anyone else to:

· Transmit any information or data, in any form, which violates any local, state, United States, or applicable international law or regulation, or that is harmful, threatening, abuse, harassing, , defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or otherwise objectionable under common standards.

· Violate or infringe any copyright, trademark, patent, or other statutory or common law proprietary rights of others.

· Send unsolicited mass e-mail messages (SPAM).

· Engage in any activity or device in an effort to disguise the origin of any transmission.

· Transmit any information or data that contains any computer virus, or any material designed to interrupt, destroy, or limit the functionality of any computer hardware or software.

· Engage in any activity in the nature of hacking, or port scanning.

· Use this Service in furtherance of any fraudulent activity.

· Engage in any activity that is in the nature of a "denial of service" attack.

Furthermore, Guest agrees that Provider may, at its sole discretion, interrupt or halt any Connectivity or services for any reason. Guest agrees that he or she will indemnify, defend and hold harmless Provider (and its directors, officers, employees, customers and agents) with respect to any claims, loss of data, file corruption, hacking, virus infection, damage to guest computer or expenses by any party that arise from your use of this service.

By utilizing, or attempting to utilize any products or services made available by Provider, Guest represents that he or she is/will:

· Twenty One (21) years of age or older.

· A registered guest for the hotel room from which you are connecting to this Service.

· Responsible for the activity and conduct of anyone that you permit to use this Service.
· Not permit a minor to use this Service to access any content intended for adults.

· In acknowledgement and acceptance of the Terms of Service.

Provider reserves the right to modify these Terms of Service at any time, effective upon posting of the modified Terms of Service.

You agree that any dispute between Guest and Provider that arises as a result of use of Service shall at Provider's sole option be brought exclusively in the State or Federal court in Tarrant County, Texas.
This Terms of Service constitutes the entire agreement between the Guest and the Provider. Provider's failure to insist upon or enforce strict performance of any provision of these Terms of Service shall not be construed as a waiver of any provision or right.
